Ansa, February 24, 2011
"In sixth section of the prison Ucciardone the showers were closed and so, to wash the inmates, using a garden hose 40 meters long and is passed from cell to cell. "is the complaint made by a former inmate, who rang Under the heading "Radiocarcere" broadcast on Radio Radical. "The water is cold, of course - said the man, recently released from prison in Palermo - and the cells, already overcrowded, increasingly resemble animal cages. There are eleven people live in, and keep us close for 22 hours a day. "
In the past, in a letter to Richard Arena, the journalist who leads the broadcast, had revealed the difficult conditions in which prisoners live dell'Ucciardone: "Viviamo ammassati in undici dentro la stessa piccola cella del vecchio carcere - scrivevano i detenuti -.

Social Editor, February 24, 2011
"Forced to live as prisoners, while not having committed any crime other than to be fleeing from countries where there has been or is being, a real civil war. " This, according to the Supervisor of prisoners of Lazio, Angiolo Brown, the paradoxical situation they are experiencing 90 of Tunisian immigrants, landed last week in Pantelleria and Lampedusa, and transferred last Friday in the Center for identification and expulsion (CIE) of Ponte Galeria.
present in the structure of Ponte Galeria 244 guests are present, 160 men and 84 women. Among the guests moved from Sicily to Rome including two minors, asylum seekers transferred to the Center of Castelnuovo di Porto managed by the Italian Red Cross. According to the sponsor, who this morning with his staff visited the property to realize the situation, that they are experiencing immigrants who came from Tunisia can only be a transitional phase, which should soon put an end to the government with a clear decision on their fate. "What happened in Tunisia, Algeria, Egypt and now in Libya - said the guarantor - would have the immediate consequence of thousands of them landing on our shores.
And if the past few days have been a dress rehearsal of what can happen in the near future, there is really to be happy. Since, at this stage for security reasons it is impossible to start the repatriation of people who arrived, and waiting to unfold a device worthy of acceptance, our government should give these desperate treatment migliore”.

Dall’inizio del 2011, secondo la Uil-Pa Penitenziari, sono 9 i detenuti morti per suicidio in his cell and attempts a little less than 50, then there are acts of self harm and many fights. " This follows the death and violence - ends-Sarno is a direct consequence of the inability to articulate courses of recovery, rehabilitation and resocialization. The staff of the prison service to do the classic jump through hoops to ensure that services will always be below the minimum levels of security. Educators, psychologists and social workers are increasingly rare species. "

If two, three criminals say you are a mafia, you're a creature of Provenzano, how do you defend yourself? Libia: mancano notizie di Giulio Lolli, in prigione vicino Tripoli Farnesina lavora per estradizione
Ansa, February 24, 2011
Still no news of Giulio Lolli, former president of Rimini Yacht investigated for massive fraud based on sales to several customers of the same mega yacht, and held some time in Libya after being arrested after an international arrest warrant.
detained in a prison located about 5-6 km from the capital Tripoli, Giulio Lolli could be fully immersed in hell that the country is experiencing now in Gaddafi's civil war, a situation in which the position of prison is not the easiest. His family are very worried, because you can not have any reliable information from Libya. Neither the attorney nor the attorney Lolli, Antonio Petroncini, were able to learn anything from the Ministry of Foreign Affairs who is intervening in Libya to repatriate nationals. Lolli for the issue is even more complicated because there is no extradition treaty between the two countries and also in these days seem to jump the diplomatic hierarchy and do not, so do not even know who to address requests, that is the unofficial official.
"The most serious - Petroncini says - is that still I was not informed nor because Lolli is held in Libya, having committed no crime in that country, nor when he was arrested by the Italians and the Libyans, or what are the charges to against him. I have repeatedly asked for lights to the Foreign Ministry, pointing out the anomaly of the situation and the risks they run my client, and I do not have deigned no reply. But not defeated, I will continue to press the Foreign Ministry, sooner or later they will give us an answer. " But the Foreign Ministry - requested on each other - you know that a request had been submitted to the extraction end of January by the Ministry of Justice. And that this request was urged today by the Ministry of Foreign Affairs who is in contact with Interpol. Lolli, explain the sources interviewed, was arrested for extradition after an Interpol international arrest warrant. "We are working to encourage the return of fellow countryman," state the same sources.

Michela Evangelisti
Il Giornale, 23 February 2011
Measures that should not be ordinary, but applied only under conditions of absolute necessity. On the controversial issue of custody Carefully word Gaetano Pecorella. It starts from disqualification measures, such as the prohibition to perform certain activities, to be in a certain place or to approach some people to get to the arrest and imprisonment. The custodial measures, the subject of controversy and reflection never dormant, have as a prerequisite for serious indications of guilt. But the requirements can not stop here, because, as explained by the lawyer Gaetano Pecorella, "is a measure that applies despite the presumption of innocence, must obey procedural reasons, that is used to prevent tampering with evidence, escape and, finally, the re-offending. " Point, the latter a contradiction in terms and in direct conflict with the principle of presumption of innocence. "While it is stated that the crime is established, to say that we apply a precautionary measure to prevent re-offending means assumed that the crime was already established - explains the lawyer. Among other things, is the most common reason for the application of protective standards, no pollution of the reasons why the test for a specified term in time, given that the test is intended to be revealed, and with regard to the danger of flight as often are sufficient measures such as house arrest or control instruments remotely. " Therefore considers that the provision relating to the keeping supervision is valid and applicable with effect or should be reconsidered? "I think the whole system should be radically changed. The prosecutor gathers evidence and makes a request for precautionary measure, often very large and contains numerous interceptions and evidence. The investigating judge is in the difficult objective of being able to assess and investigate all of these elements, having tight deadlines, and ends up relying mostly on the assessments of the public prosecutor, to the point that it is not uncommon to find arrest warrants that follow to the letter the request of the prosecutor. The court of review, upon which pour an avalanche of statements and actions, must move in a very short time, and ends in turn to align themselves with the decisions of the investigating judge. Unfortunately, in Italy, as noted at the time Vassalli, the day the sentence is often the day of release, because it was obvious all the punishment during a precautionary measure. " What could be the radical change? "It could take as an example the French system, the so-called adversarial advance. Apply a restrictive measure provisionally, that does not or should not lead to imprisonment, but in special institutions, then it creates a real heard before a judge or a court, after which the court decides whether to apply a measure supervision of a permanent nature. The paradox of our system is that Article 111 provides that there should be, before a person is incarcerated to serve his sentence, an adversarial in equal shares, but at least half of the Italian prisoners are awaiting trial without having had a real contradiction, either before the investigating judge or to court review. Everything is based solely on the evidence that was gathered by the prosecutor, the so-called right of habeas corpus by us does not exist. " The pre-trial detention is a measure that should be ordered only in exceptional cases for very short periods, while in Italy it is an abnormal use. What are the causes of this misuse of the law? The separation of the careers of prosecutors and judges could be a solution to arrive at the correct application of the law on custody? "The separation of careers is changing the face of the overall criminal justice system. Pm The time will eventually be seen by the court as a part, just as the defender. Today is not so much that they say that the court is provided with the prosecution. Why do you use such a broad pre-trial detention? Not by chance has been called a sweet torture, because it is a very strong instrument of psychological pressure. In prison they weaken the will of defense: get out of jail while the accused, for fear of being subject to violence or submission, eventually confess or cooperate. The custody some time is also used successfully to preserve evidence or prevent the danger of escape, but especially for certain crimes where there is no violence or danger of flight, such as corruption, you may choose other paths. " A change of 2009 had again expanded to a large number of crimes, including sexual ones, the exceptional rule that, where there are serious indications of guilt, the judiciary must still apply the pre-trial detention. The Constitutional Court then deleted the rule requiring the prosecutor to apply on remand in prison for those suspected of crimes of exploitation of child prostitution. The decision of the visit has provoked controversy in the world of associations, which have accused the court of justification. What do you think? "The Constitutional Court has no grounds to justify be-shareholder: curtains always, despite its errors, to enforce the Constitution, which says clearly that the protective order must be exceptional, not ordinary. The court is correct in saying that, beyond reasons of "propaganda" or electoral support, the measure should be applied when there is a case for its necessity. " For decades our policy that responds to the emergency prisons or by acts of clemency or prison construction plans, but the problem is now resolved. In Secondly, we should rethink the whole prison system separately, as in hell, the circles: semi-open or open the prison for minor offenses to prison more restrictive. It would also be very useful to introduce a measure that works well in the Anglo-Saxon countries, namely the security: if you do pay a certain sum is also relevant, depending on economic conditions, and you lose the amount that escaped. A measure is also convenient to pay your legal fees and compensate the victims at the end of the process. You might consider alternative sentences, such as the compulsory work in assisting the elderly or the sick, and increased measures of assets, especially for certain economic crimes. Finally Prison should be conceived as a place of education and not cut the family and social ties: an important part of sexuality that is also in prison, a right that I should at least be guaranteed to persons awaiting trial. "

www.blitzquotidiano.it, February 24, 2011
in prison in Libya without any real accusation: that is what has happened to an Italian researcher from the University of London, told the daily act. "When you spend three weeks in jail in Libya come to mind many things. Look at photos of Berlusconi kissing Gaddafi in Tripoli and you wonder if it is you have to be sacrificed on the altar of economic interests. Think of all the agreements between Italy and Libya, and see that talk about human rights then you are systematically denied. "
The man, who asked to remain anonymous, was arrested in Tripoli on December 4 last year. It is able to return to Italy on Christmas Eve after having spent twenty days in Libyan prisons "without trial or accusation. But above all, without which none of the Italian Embassy or Consulate you did live. Her crime, writes the Fact, "I met people do not like the procedure: two boys of the Berber minority, they also arrested by the Libyan services December 16 and, according to the complaint Amnesty International, torture in prison. The brothers and Mazigh Maghris Bouzahar were released Sunday. "
The researcher was over to Libya to study a Berber dialect being spoken in small communities do extinction of Augila. There she meets one of the twins Bouzahar, activists dedicated to the promotion of Berber culture and members of the World Amazigh Congress.
Back in Tripoli on December 4, was stopped at the airport. Is returned to the hotel, and there, in his laptop, found the documents on the Berber language. All I can do is warn the Italian consulate, which promises to make inquiries. But then the student does not receive any news, excluded from all communication with the outside world for twenty days.
"For hours I was asked to explain each day where I was, who I had met and what I did," said Fact. Hours of questioning, the signing of the minutes in Arabic without translation. Detained man collects the testimonies of those who have suffered torture and beatings by security forces.
After five days the man was transferred to solitary confinement. Finally, someone begins to believe that this man was only a researcher with an academic project and science. On 22 December he was taken to a hotel. At the end of an academic commission Libyan money to his account, and he can finally return to Italy.
There are still some questions, points out: "Why in the twenty days no Italian authorities managed to get in touch with an Italian citizen detained without charge in a Libyan jail? What happened to the vaunted special relationship? And if it is true that the Consulate has asked several times in Tripoli because the information has been given and what formal steps have been made to them? And because the man was asked to disclose on the event? "
" For two months, says the researcher, a bit 'selfish, I thought it was right not to disturb the manipulator and that perhaps would not have even helped my research projects. Then came the events and the dead. The silence began to weigh. And when my friends Libyans have been released, it's time to tell. "

"The despair expressed dramatically by the Moroccan detainee - said Caligaris - stems from a sum of contradictions of a prison system that retrains but not only drive people away from the few human and social relationships built on arrival in Italy, it cancels out any possibility of social rehabilitation . The territoriality of punishment is a principle which must be respected even for non-rooted in the territorial areas of the nation.
In this case the prisoner, arrested in Milan, despite being in possession of a residence permit, not a house or a friend or relative who can host it.

Ecco, istituto per istituto, il numero of OPG of 6 held in Italy divided on the basis of the legal position.
